The short version
These terms apply to everyone who uses Drams Direct at www.dramsdirectonline.com, whether you are browsing, buying or selling. "We", "us" and "our" mean Drams Direct. "You" means the person using the site.
By creating an account, you confirm that you have read and accepted these terms, together with our Privacy Policy and our Shipping & Refund Policy. If you do not agree with them, please do not use the site.
We may ask for proof of age or identity at any time, and we may suspend an account until we have received it.
Drams Direct is an online marketplace. We provide the site, the listings, the messaging, the checkout and the shipping labels. We are not the seller of any bottle listed on the site and we do not own, inspect, store or authenticate the bottles.
When you buy a bottle, the contract of sale is between you and the seller. Sellers are responsible for their listings and for the bottles they send. We do our best to keep the marketplace safe and trustworthy, and we step in when something goes wrong, as described in section 10.
You are responsible for everything done through your account. Keep your login details private and tell us straight away if you think someone else has accessed your account. One person may hold one account, and accounts cannot be transferred.
When you list a bottle, you confirm that:
You must not list counterfeit, stolen, opened or refilled bottles, empty bottles presented as full, or anything other than whisky and related items that we allow. We may edit, reject or remove any listing, and we may ask for extra photos or proof of purchase before a listing goes live or a payout is released.
If you sell as a business rather than as a private individual, you must say so, and you must give buyers the rights that the law gives consumers who buy from a business.
Sellers set their own prices. Where offers are enabled, a buyer and seller can agree a different price, and an accepted offer is a commitment to buy and sell at that price.
Listing a bottle is free. When a bottle sells, we deduct a commission from the sale price before paying the seller. The commission rate is shown to you before you list and in your dashboard. Payment processing fees may also be deducted. All prices are in pounds sterling.
Buyers and sellers must complete sales through Drams Direct. Arranging payment outside the site to avoid our fees is not allowed, and it removes the protection described in these terms.
Payments are processed by our payment provider, Stripe. Buyers pay the bottle price plus the delivery charge shown at checkout. We do not store your card details.
To receive payouts, sellers must complete Stripe's verification, which includes identity checks. The seller's money is held after the sale and released as described in section 9.
The bottle remains the seller's responsibility until it has been delivered to the buyer.
A few days after the parcel is shipped, we email the buyer and ask them to confirm that the bottle has arrived as described.
Buyers should check their bottle promptly on arrival. Once the payout has been released, we may no longer be able to recover the money from the seller on your behalf.
Tell us, using the order page, before the payout is released if your bottle:
We will ask both sides for information, such as photos of the bottle and packaging. We may ask the buyer to return the bottle to the seller. Based on what we receive, we will decide whether the buyer is refunded or the seller is paid, and both sides agree to accept that decision for the purposes of the money we hold.
Most sellers on Drams Direct are private individuals. When you buy from a private individual, the legal right to cancel a distance purchase within 14 days for any reason does not apply, so a bottle cannot be returned simply because you have changed your mind. If the seller is a business, your statutory rights as a consumer apply and nothing in these terms reduces them.
Full details are in our Shipping & Refund Policy.
We may remove listings, hold payouts, cancel orders, or suspend or close an account if we reasonably believe these terms have been broken, that a bottle is not genuine, or that there is a risk of fraud or harm to other users. You can close your account at any time once your open orders are complete.
We provide the marketplace with reasonable care and skill, but we do not guarantee that it will always be available or free of errors. We do not guarantee the authenticity, quality, condition or value of any bottle, or that any seller or buyer will complete a sale.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Apart from that, we are not liable for losses that were not foreseeable, for business losses, or for the acts of other users, and our total liability to you for any order is limited to the amount you paid or were due to receive for that order.
Whisky is bought and sold here for enjoyment and collecting. Nothing on the site is investment advice, and the value of a bottle can go down as well as up.
We may update these terms from time to time. The date at the top shows when they were last changed. If a change is significant, we will tell you by email or on the site. Orders are governed by the terms in force when the order was placed.
These terms are governed by the law of Scotland. If you live elsewhere in the United Kingdom, you may also bring a claim in the courts of the country you live in.
